Vioxx Settlement -- Ever wonder how subrogation claims are resolved in mass tort actions?  The insurance companies get together and negotiate a global settlement.  In the Vioxx case, the settlement is optional for the claimants.  If they opt-in, the insurance company only recovers 50% of its claim, capped at 15% of the claimants total settlement.  See Associated Press Article.
